H.E. U Tun Tun Oo, the Attorney General of the Union, received the delegation led by Mr pasit Asawawattanapom, Managing Director from Thailand Arbitration Center (TAC) in the International Call Chamber of the Union Attorney General’s Office at 10 a.m. this morning.
In the meeting, Mr Pasit explained that Thailand Arbitration Centre was established in 2007 and performed with three objectives; the Centre was comprised of the Attorney General of Thailand and other relevant senior officers and it was supported by the Ministry of Justice temporarily; it has twenty branch offices and a professor from New York will come and give training for officers this month; the Centre is an independent organization and the Arbitration Act,1984 was inconsistent with UNCITRAL Rules and it was amended; the Centre coordinates with the Courts for changing Arbitration process and so on.
The Attorney General of the Union also discussed that he welcomes to the delegation led by Mr Pasit Asawawattanaporn, Managing Director from Thailand Arbitration Center (TAC); there has been no establishment of Arbitration Centre in Myanmar until now; Arbitration Act was enacted in t944 and repealed in 2016 then the new law was enacted; Myanmar became a member of the New York Convention in 2013 and Myanmar Citizen Investment Law and Foreign Investment Law were enacted in 1989; the Myanmar Investment Law was enacted in combination of these two laws; the provisions relating to the settlement of disputes and disputes settlement mechanisms are included in the new law to be able to settle the disputes before the Courts and Arbitral Tribunals. Currently, our office applies rules for Arbitration clause under LINCITRAL Rules when the ministries conclude the agreements; if both parties agree the agreement, our office applies it according to other Arbitration Rules such as ICSID; the community based dispute settlement mechanism has been practised since ancient times; Legal Aid Society and International Institutions support the trainings for dispute settlement mechanisms; the Union Attorney General’s Office desires to cooperate with TAC for the raising awareness and knowledge of Arbitration.
The Attorney General of the Union also received the authorities from the Korea International Cooperation Agency (KOICA) and discussed the matters of the establishment of Myanmar Law Information system (MLIS).
The Deputy Attorney General, the Permanent Secretary and Directors General also attended those meetings.
