Holding the first meeting of Bar Council (1/2022)

The first meeting of Bar Council (1/2022) was hold at thb Bar Council Office in Cluster-I, building No.6 of the Nay Pyi Taw Goal Camp, Wanathidi Quarter, Zabuthiri Township, Nay Pyi Taw this morning in accordance with the Social Distancing rules of control of Covid-19.

In the meeting, Chairperson of the Bar Council, Union Minister for Legal Affairs and Union Attorney-General Dr.Thida Oo said that: Bar Council Law is amended by law No.61/ 2021 of the State Administration Council on October 28, in 2021, and the Bar Council has been reformed in accordance with such law; the members of the Council will be able to perform a wide range of their duties for the benefits of the people without political intentions; one of the main functions of the Bar Council is scrutinizing the complaints against the advocates and referring certain complaints that should be referred to the Supreme Court of the Union to take proper actions; with respect to the misconduct of the advocates, the Council gives the recommendation to the Supreme Court of the Union to take proper actions against advocates in accordance with the code of conduct of the lawyers after holding the plenary session leading by the Chairperson of the council when the Supreme Court of the Union so requested the recommendation on whether to take action under the Bar Council Act Section 10(1); the Council gives the recommendation to the Supreme Court of the Union in accordance with the enrolment rules by forming Bar Council Enrolment Scrutinization Body whether the Bar Council has any objection to the applications for enrolment as advocates, when the Supreme Court of the Union so requested; during the control of Covid-19 period when the plenary sessions cannot be held, the Council asked for the recommendation of each members through e-mail, and then the Council reply to the Supreme Court of the Union after approving the majority recommendation given by each members; when the number of members who made objection and no objection is equal, the Chairperson has to decide and then reply to the Supreme Court of the Union; if the persons whose names are cancelled from the advocate registration list or whose right to conduct the cases is suspended for (l) year, (2) years, (3) years or (5) years submit petitions to the Council, the Council sends the petitions to the Supreme Court of the Union after discussing about the matters; the Council gives the recommendation to the Supreme Court of the Union whether it has any objections to the applications in accordance with the enrollment rules when the Supreme Court of the Union so requested the recommendation on the applications of the staff serving at the respective Ministries and those who completed the online Post Graduate Diploma in Law of the Yangon University of Distance to register as advocates, and it also approves the complaints against advocates to refer to the Supreme Court of the Union to take necessary action, which are referred by government organizations.

The Chairperson of the Bar Council, Supreme Court Judge U Myo Tint who is Vice-Chairperson of the Council, the members of the Council: Deputy Minister of Ministry of Legal Affairs and Deputy Attorney General U San Lwin, the advocates U Myo Thein, Daw Khin Nu Thar, U Hia Han, U Soe Mying, U Soe Thein and U Win Phay, Director General Daw Tin Nwe Soe, Office of the Union Justiciary Supervision, Union Supreme Court, the Secretary of the Council, Dr, Thi Thi Myint, Director General of the Ministry of Legal Affairs attended this meeting.
