Holding the Opening Ceremony of Legislative Drafting and Legislative Vetting and Advising on Laws (Draft) Course No.1/2021 of the Office of the Attorney General of the Union

The opening ceremony of legislative drafting and legislative vetting and advising on Laws (Draft) course No. 1/2021 was held at 10:00 a.m. today and H.E. Dr. Thida 00, the Attorney General of the Union attended and delivered the opening speech at the ceremony.

In the speech of the Attorney General of the Union, she said that the legislation plays the main role in applying checks and balances between legislative, executive and judiciary to maintain separation of the sovereignty of a State, the Office of the Attorney General of the Union is the organization that involves in all three sovereign powers of the State; with regard to the legislative sector, the Office of the Attorney General of the Union was responsible for drafting and scrutinizing the laws under The Attorney General Law 1988 in the period of State Law and Order Restoration Council and also carried out the duty of drafting and scrutinizing the laws under The Attorney General Law 2001 in the period of State Peace and Development Council; after promulgation of 2008 Constitution of the Republic of the Union of Myanmar, the Office of the Attorney General of the Union has no responsibility for drafting the laws under The Attorney General of the Union Law 2010 but only has responsibility for legislative vetting and advising on draft laws; the Union level organizations, government departments, government organizations that will administer the relevant laws, are initially responsible for drafting the laws and the Office of the Union Attorney General of the Union is only responsible for legislative vetting and advising on those draft laws sent by relevant Union level organizations, government departments, government organizations; likewise, responsible persons of Region or State level government departments and organizations initially have to draft the laws that are relevant to their departments and organizations under the guidance of the Region or State government, and Region or State Advocate General Offices are responsible for legislative vetting and advising on those draft laws sent by such relevant government departments and organizations; to provide the assistance for the person or organization that involves in the legislative drafting process, the Office of the Attorney General of the Union published the Legislative Drafting Guidance in November, 2019; the Office of the Attorney General of the Union has prepared to deliver the course on how to use the Legislative Drafting Guidance since 2020, but that plan has temporarily suspended because of the outbreak of Covid-19 pandemic around the world; during the whole year of 2020, responsible officers of the Office of the Attorney General of the Union held several coordinating meetings and made timetables for various types of training, selecting the trainers, compiling the curriculum and preparing relevant teaching aids and documents that will be used in the courses to be ready when they are allowed to open; although this training is intended to be opened for all law officers who serve in the whole State but as the first step, it is opened for law officers who serve in the Office of the Attorney General of the Union in accordance with the regulations prescribed in the period of Covid-19 pandemic, in this training the trainers will teach and train the trainees with sample exercises to follow the guidelines in Legislative Drafting Guidance in practice, the Deputy Director General and Directors of Legislative Vetting and Advising Department will teach the trainees with exercises how to draft the laws and vet the draft laws and subordinate draft laws in this course, and that will be very precious for law officers; finally, the Attorney General of the Union urged the trainees to absorb the professional knowledge from trainers with special diligence.

The Office of the Attorney General of the Union
