The opening ceremony of the Basic Training Course on Commercial Contracts No. 2/2021 was held at the ground floor meeting room of the Ministry of Legal Affairs at 09:30 a.m on 23.11.2021, and H.E. Dr. Thida Oo, the Union Minister and Attorney General of the Union, addressed the opening speech.
At the ceremony, the Union Minister and Attorney General of the Union said that Ministry of Legal Affairs is disseminating Legal knowledge in accordance with the guidance of the Chairperson of the State Administration Council; training course on making and vetting of commercial contracts was held for the officers of Ministry of Legal Affairs; for the time being, this Basic Training Course is opened for other Ministries and to disseminate knowledge about commercial contracts through the officers who attend this training course, in their respective Ministries; the total number of 40 trainees from the Ministry of Defence, Ministry of Planning and Finance, Ministry of Agriculture, Livestock and Irrigation, Ministry of Cooperative and Rural Development, Ministry of Natural Resources and Environmental Conservation, Ministry of Electricity and Energy, Ministry of Industry and Ministry of Legal Affairs attend this training course in accordance with the rules of prevention of Covid-19 and the duration of the course will be November 23 to 26; the purpose of the training course is that the officers from other ministries including Ministry of Legal Affairs can give effective legal advice on commercial contracts in time in accordance with the vision of “Providing Legal Service for Justice” strategic plan (2020-2023); Ministry of Legal Affairs has to give Legal advice in respect of memorandums of understanding, record agreements, local and international investment contracts and other contracts to the Union Level Organizations under subsection (l) of section 12 of the Attorney-General of the Union Law; the guidance on making contracts (Notification No.41/ 2018) was issued by the President Office on 1.6.2018; in the case of inviting tender, Notification No. l/ 2017 of the President Office shall be followed; in the case of lease, transfer and joint-venture, Notification No.3/ 2018 issued by President Office on 10.12.2018 shall be followed; Ministry of Legal Affairs vets Commercial Contracts that are concluded between Government Organizations and local or international investors, companies or institutions in accordance with existing laws, rules and regulations not to harm any parties and to be valid commercial contracts; it is important to know the basic principles although commercial contracts may be different according to the nature of contracts; and she urged the trainees to try their best to improve their skill at work by learning the basic principles of commercial contracts in this training course, theoretically and practically.
